MISSING GOLD CHAIN.
OWNER SUES PAWNBROKER. AN UNSUCCESSFUL CLAIM. A claim for £25 was made in the Magistrate's Court yesterday by T. C. Mandeno (Mr. Wilson), against Emanuel Kissen, pawnbroker (Mr. Singer), plaintiff alleging that be had suffered damages through defendant wrongfully depriving him of a gold chain. The facts were that about two and ahalf years ago plaintiff lost or had stolen from him a pendant and gold chain. Recently he saw the pendant in defendant's khop * window, and informed the police. Defendant ga?e him back the pendant, but the gold chain wss still missing. Detective Mcfiagh said defendant's books had been examined, but as there were a number of pendants pledged it was difficult to trace this one. The pendant was net part of the chain, but was attached to it with a split ring. Mr. Singer submitted that the chain might easily have been melted down by a thief, and the pendant sold later. The magistrate, Mr. McKean, said the evidence was not sufficient to show that both the chain and pendant came into defendant's hands. Plaintiff was accordingly non-suited and defendant allowed costs.
