SERIOUS CASE RETRIED.

IDENTIFICATION QUESTION. The retrial of John Frederick Davis Telford (Mr. A. Moody), for rape, or, alternatively, attempted rape, was opened before Mr. Justice Hoed in the Supremo Court yesterday. His Honor ordered the Court to bo cleared. The accused appeared originally before Mr. Justice Herdmau in November, and after the evidence had been taken it was discovered a relative of accused was serving on the jury. After consulting with Mr. Justice Stringer, the Judge discharged the jury and ordered a retrial. Mr. Patcrson, for the Crown, said the girl concerned was deaf and dumb, and it' was necessary to have her evidence taken through an interpreter, skilled in lip-reading. The offence was alleged to have taken place at Grey Lynn, where both'the girl and accused lived. His Honor said it was only a question of identification. Tho case was adjourned until to-day.
