WORKER'S CLAIM FAILS.

ARBITRATION COURT JUDGMENT.

Judgment has been delivered in tho Arbitration Court in the claim for compensation brought by Arthur Brown (Mr. P. J. O'Regan), waterside worker, against tho Union Steam Ship Company (Mr. P. Levi) in respect of an injury received accidentally on September 16.

Mr. Justice Frazer said plaintiff was employed to work in ono of the company's steamers at Miramar Wharf, Wellington. On the day mentioned work ceased at 3 p.m., and the waterside workers went home. While walking on the public road plaintiff trod on a loose stone, jarred his knee and, as an effect of his injuries, had since been unable to work. The accident, occurred within 10 minutes of plaintiff leaving his work. Plaintiff was entitled to his wages up to 3 p.m., plus a payment equivalent to three-quarters of an hour's pay. The latter payment was to compensate him for the loss of time in travelling from Miramar. He was absolutely free f-om all control by his employer at 3 p.m. He would, of course, be entitled to compensation for any accidental injury rece;.vei while leaving the wharf or its approaches, but after he had reached the public road it could not be said that ho was in the course of his employment. When on his way home he was not engaged in doing something ho was employed to do. Judgment would be for the defendant company, and leave reserved to apply for costs.
