The statutory obligation on an owner of a vessel which arrived at Wellington so loaded as to submerge in salt water the centre disc indicating the load-line was defined by Mr. E. Page, S.M., in a reserved judgment in the case in which the Superintendent of Marine proceeded against W. A. Hutching, master of the American steamer Shreveport, for a breach of the (Shipping and Seamen Act.
The magistrate pointed out that ho was not called upon to decide the position of a vessel, whether British or foreign, that might arrive in New Zealand without a load-line marked on her, coming from a port where the marking of a load-line was not required. Tho vessel in question had been in Now Zealand previously and had had a load-line painted on her, her master being advised that if she returned to New Zealand her load-line must not be submerged. In entering a conviction he said ho considered that something more than a nominal penalty would have to bo imposed. The master of the vessed had been advised as to what was the law and he had chosen to disregard it. Ho would be fined £25 and costs £2 9s.
