DISPUTE OVER SEPARATOR.
HIRE PURCHASE UNCOMPLETED.

Reserved decis.on in th.t action brought by William Bolt n, of Pi kekaha, farmer, against D. McL. Wallace, Ltd., general merchants, Hamilton and Tc Aroha, was delivered yesterday by Mr. H. A. Young, S.M. The plaintiff, for whom Mr. A. L. Tompkins appeared, claimed possession of a separator and damages for its wrongful detention. The defendant company, for whom Mr. W. King appeared, maintained that the separator was under a true hire purchase agreement with one Morrison, and that no property in it passed to Morrison until all instalments had been paid. The magistrate held that no property in the goods had passed to Morrison under the hire purchase agreement. He agreed with u reccnt decision in Wellington wherein the owner's title to tlio goods under similar circumstances was deemed unaffected by tin? provisions of the 1922 Act.
Plaintiff was non-suited. Costs and witnesses' expenses, £6 3s, were allowed to the defendant company. Security for appeal was fixed at £10 and the costs.
