JUDGMENT FOR PLAINTIFF.
Judgment was delivered by Mr. F. K. Hunt, S.M., ,at : 'the Magistrate's Court yesterday in 'a,;case in which ;'• S. Bilkoy, farmer, of Taupiri, (Mr. 7 Endean), : claimed £25 17s 6d from Tal Sang,'vegetable :.- gardener (Mr. . Leary), for- seed potatoes alleged^ to have been delivered to defendant., ; The defence! was that the potatoes were not up ;to sample quality, it being contended; that: a quantity, had been affected by blight. . ..
The magistrate held that defendant had not inspected the potatoes promptly; on delivery. .A delay ■■■ had : resulted .=in ■ depreciation in" quality..' * When .complaint was made, plaintiff found there was no blight, but :a, quantity, of the supply was affected by wet rot. Judgment was' for plaintiff with costs.
