UNCOMPLETED TRANSACTION,
Reserved judgment -was given by jj W. R. McKean, S.M., in the Magistra^'g. Court yesterday, in a case in which Tomlinson, land agent (Mr. ,Mc«sbi* '. sought from J. C. Lean, oi' Auckland(Mr. Rudd), the sura of £42 10s, alleged-'' to be due in respect of commission. :;
Plaintiff, it was stated, introduced to defendant a client who had a property for exchange. An offer was accepted (o f sale and purchase, but preparation of the agreement was not completed because de. fendant was not able to find the. amount of cash required.
The magistrate held that plaintiff could not recover, because the contract for remuneration, incorporated in the authority to sell was for remuneration in the event of sale only. Judgment was entered for defendant, with costs.
