CROSS ASSAULT CASE.
QUESTION OF PROVOCATION.
TROUBLE ! AT NGATEA.
A fracas which occurred at Ngatea, Hauraki Plains, cm October 16, 1923, had its sequel in the Magistrate's Court yesterday, when Henry Grundy, of Auckland, farmer (Mr. Hogben), sued Hallyborton Johnstone, of Point Chevalier, farmer ■ (Mr. Jordan), for £100 general damages and £88 lis ■"' special damages for alleged assault. Defendant counterclaimed for £199 damages on similar grounds. It was stated that defendant had attacked plaintiff in a store and had inflicted injuries that caused him considerable suffering. The assault was admitted by defendant, wha 'alleged provocation, and stated in his counterclaim that plaintiff had returned the assault same hours later and had caused him painful in juries. This assault was admitted by plaintiff, who also contended that he had received provocation. ■
After hearing evidence Mr. E. C* Outten, S.M.', iield that the counterclaim could not be sustained. Judgment was accordingly given for plaintiff for £100 damages.
