MAGISTRATE'S COURT.
MOTOR-CARS IN COLLISION. DAMAGES AWARDED. A claim for £30 10s damages arising out of a. collision between two motor-cars in Anzac Avenue last November, was heard before Mr. J. W. Poynton, S.M., ill the Magistrate's Court, yesterday, the plaintiff being Wally Mahomed Salaman (Mr. Hubble), a Hindoo doctor, and ; the defendants. John Roberts and Sons, Ltd. (Mr. Beckerlegg). Defendants counter claimed for £24 12s 6d. It wag stated that plaintiff was driving his car from Customs Street East into Anzac Avenue when defendant drove from Beach Road into the Avenue between plaintiff's car and the footpath. Several witnesses testified that defendant . was driving considerably faster than - plaintiff. •: t. . Defendant alleged that plaintiff's car collided with the rear of his own. 'die magistrate stated that the weight of evidence was in favour of plaintiff, and gave judgment for £15 ! '10s damages and costs. On the counter-claim judgment W..5 for Salaman, with costs £2 2s. Security for appsal was fixed 'at £20 plus ; the amount of judgment ' and costs. DISPUTE OVER BENT. A claim for £15 rent alleged to be owing by Albert Jennings, scow captkin, of Auckland, and Nancy Louisa Jennings (Mr. J. C. Tole), to Mrs. E. S. Rie, widow, of Auckland (Mr. Sellar), ■ was heard. before Mr. E. C. Gotten, •> S.M. Plaintiff stated that she let a house to defendant on February 12, 1923, at £2 a week. Defendant did not occupy the house until ; May 14. The oney claimed was a portion of the kw lor ■ that period. ' ' ' . ... The defence was a denial of liability. The magistrate gave judgmeni; for the full amount claimed: with costs £5 ss.
