ICE CREAMS ON SUNDAY.
" ONLY A TRIVIAL OFFENCE." HAMILTON CASE DISMISSED. fur EGRAPH. —OWN CORRESPONDENT. HAMILTON". Monday. A sequfel to the case of Sunday trading heard in the Magistrate's Court last Monday, when Mrs. Hayes, proprietress of the Lake Kiosk, was charged, took place at the Hamilton Magistrate's Court today, when the Velvet Ice Cream Company and Laurence Aston Merlow. an employee of the company, were charged separately that "they did, in a public place, to wit, the Lake Domain, on a Sunday; trade, deal, or transact business or expose goods for sale."
"It comes as a natural corollvy io the dismissal of a similar case heard last Court day that this charge should fail," contended Mr. Strang. "If it were not illegal," continued counsel, "for Mrs. Hayes to sell ice creams on Sundays at the lake, then it was quite in order thai manufacturers should supply her. Ice creams lasted only a few hours during this weather, and it was impossible to manufacture Sunday's supply on the previous day, or for Mrs. Hayes to make ice cream on the premises." The Bench considered that an offence had been committed, but as it was only a trivial one it would be dismissed*
