A CREDITOR'S CLAIM.
PROOF OF A DEBT.
A motion to reverse a decision by the official assignee rejecting a proof of debt in the bankrupt estate of John H. McGinley, was made in the Supreme Court in Bankruptcy yesterday, before Mr. Justice Herdman, by William Frederick Dolan (Mr. Leary). It was stated that Dolan., a land agent, had sold McGinley's house and retained £20 as part of his fee from the deposit of £45. Later the purchaser sued for return of the deposit, and the land agent paid the amount of the judgment. The debt was claimed to be £61 4s, of which £31 was admitted by the official assignee. His Honor held that the judgment would have to stand, and that Dolan was entitled to prove for the full amount of the debt, . less £20.
