BANKRUPTS CHARGED.
NO PROPER BOOKS KEPT. PROBATION ' AND RESTITUTION. The charges under the Bankruptcy Actwere dealt with in the Police Court yesterday before Mr. J. W. Poynton, S.M. Daniel Cariine, who was charged on the information of the official assignee with failing to keep proper books and obtaining credit without disclosing that he was an undischarged bankrupt,. was admitted to probation for three years, and was ordered to pay cost 3, and ,to make restitution to the creditors concerned to the extent of 6a 8d in the £. J; ■ ANOTHER CASE ADJOURNED. PLEA OF NOT GUILTY ENTERED. The official ' assignee (represented by Mr. V. N. Hubble) also proceeded against, Douglas Lees, draper, of Valley Road, ; Mount Eden, for. allegedly failing to keep ; proper books within three years of his I bankruptcy. ! Evidence was given that only two email scrap-books containing information, were kept, and a statement of his position was prepared only with the assistance of bank- j rupt himself. Of receipts totalling £3400, only £1000 went through the bank pass- ! book. • •, • . j For defendant, Mr. Butler entered a ! plea of not guilty. He stated that there 1 was another book of the records, of re- | ceipts and disbursements, but it had been j i taken away*. Defendant had his _ thigh j fractured in France in 1917, and this had j been a handicap. Loss had also occurred j through his travellers. j • The magistrate said that in the state of , defendant's health, it would be use- ! less to make an order for restitution, but ! it was a serious matter for money ad- j ; vanced£2oo from the Patriotic Fund, i and £300 from the Repatriation DepartI mentto be lost in this manner. However, j he would defer the 1 ; matter for a week for ! the report of the probation officer.
