' FATALITY AT A SAWMILL.
SUIT ON BEHALF OF MOTHER
JUDGMENT FOR DEFENDANTS
Compensation claims -were beard yesterday by the Arbitration Court, Mr. Justice Frazer presiding.
A claim for £500 under tho Workers' Compensation Act was made by tbo "Public Trustee, as administrator of the estate of the late William Ku Rako (Mr. Butler), against the Baugiora Timber Company, Ltd., sawmillors, of Kokukohu (Mr. A. K. Johnstone).
Tho statement of claim set out that deceased, William Ku Ra-ko, died on January 10, 1921, as a result of an accident -during his employment. The ■weekly earnings were £4 8s por week, and his mother was partially dependent on him.
Evidence was given that deceased was crossing the mill to sharpen hi-: axe at the grindstone but he crawled under the machinery to reach tho othor side and was caught up and killed. The Court held that the deceased had added a risk to his employment which was not covered by his contract, and therefore the accident did not arise out of his employment. Judgment was for defendant with costs.
