DISPUTE OVER PROPERTY.
HUSBAND VERSUS WIFE. [BY TELEGRAPH. —OWN CORRESPONDENT.] GISBORNE. Friday Judgment was delivered in the Supremo Court to-day in a case which came before Mr. Justice Reed-at a recent sitting of tho Court in Gisborne, tho plaintiff, James Charles Dunlop. claiming from the defendant, his wife, Emma Mary Dunlop, a half share of property standing in the name of the wife. His Honor quotod authority for the view that when a husband transfers money or other property into tho name of his wife only, then tho presumption is that it is intended as a gift or advancement to the wifo absolutely and at once, subject to such marital control as-tho husband might exercise. Plaintiff had not satisfied him that there was ever any arrangement or agreement that the property.should bo held by defendant otherwise than as her own absolute property. Judgment would bo for tho defendant, with costs on the highest scaleas on a judgment of £1000.
