A BY-LAW CHALLENGED.

PROTECTION OF FRUIT. t

A number of fruitorors were charged at tho Police Court, before Mr. J. W. Poynton, S.M., yesterday, with having failed to protect fresh fruit, ordinarily consumed in its raw state, from dust and flies. Mr. Dickson appeared for defendants, instructed by the Retail Fruiterers' Association, and entered a plea of not guilty, contesting tho validity of the by-law. One case was taken as a test. The dofenoe was that the by-law was unreasonable, uncertain, too general, would embarrass trade and was not an effective means of dealing with dust and flies. After a number of witnesses had been heard further hearinc of tho case was adjourned for a fortnight.
