CLAIM FOR WAGES FAILS.
JUSTIFIED DISMISSAL.
An action arising from a driver's dismissal came before Mr. W. R. McKean,' S.M., in the Magistrate's Court yesterday. 0. F. Bennett (Mr. Holmden), driver, sought to recover from W. Patterson (Mr. Mackay), contractor, £10 18s od, the sum being made up by £6 8s 6d wages alleged to be duo, and one week's wages, £4 10s, in lieu of notice. The evidence showed thtit plaintiff hid teen requested to go back to work on ihe Wednesday after Christmas. Other men employed by defendant had returned, but plaintiff did not do so, and bis place was filled when ho returned the following Wednesday. The defence was that plaintiff had been dismissed for disobedience, or, in the alternative, that he had volunjtarily left defendant's employment. The magistrate held that plaintiff's dismissal was justified. So far as the other part of the claim was concerned, it was law that if an employee failed to work for the full period for which he was engaged he forfeited payment for the broken period. Judgment was for defendant, with costs.
