SHARE-MILKING DISPUTE.
SUPREME COURT ACTION. JUDGMENT FOE PLAINTIFF. Judgment for plaintiff was entered by Mr. Justice Adams at the Supreme Court en Saturday in the case in -which Harold Partington (Mr. A. E. Skelton) claimed £501 from Charles Hilton Ingley (Mr. Hall Skelton), for alleged breach of a share - milking contract. Defendant connter-claimed £660 16a for alleged loss of profit on 30 cows and other alleged losses. The case was commenced on Monday before His Honor and a jary of 12, and continued throughout the week. His Honor, in summing up, said there was conflicting evidence on almost every point. If the plaintiff and hia wife had taken over management of a large herd but could not make a success of it, their intention was probably quite all right. But if. through their mismanagement, the herd Bad reduced its milk supply and calves and increased the number of dry cows, plaintiff must take responsibility for this. The jury retired shortly before noon and after deliberating for five and aquarter houra returned: » majority verdict for the plaintiff on both claim and counter claim. On the issues put to them, they found that- the plaintiff bad not been negligent and that defendant was not justified in dismissing him. The. damages were assessed at £150, and costs. His Honor allowed costs, reserving the craesr tion of costs for each succeeding day of tße ease for consideration in Chambers.
