ALLEGED BREACH OF LEASE.

JURY DISCHARGED FROM CASK.

The action in which Ernest Edwards (Mr. A. Hall Skelton), fruiterer, of Grey Lynn, claimed from Joseph Wilkins (Mr. A. E. Skelton), cSfdener. of Mount Albert, £700 damages for alleged breach of the conditions of a lease, which was commenced at the Supreme Court on Tuesday before Mr. Justice Cooper and a jury of 12, was continued yesterday. The hearing of evidence had been concluded on the previous day, and the matter of drawing up a set of issues to be placed before the jury was left to counsel. When the Court resumed yesterday Mr. Justice Cooper announced that it had been agreed by counsel that the question of fact in the case was so involved with the question of law that it -was desirable that the whole matter should be decided bv the Judge. The jury -was therefore dismissed. The Judge said ha would fix ft data for the hearing of argument by counsel as soon as possible.
