SEPARATION ORDER REFUSED.
MAINTENANCE FOR CHILDREN. An -application for a separation order and maintenance made By Ellen Heenan (Mr. R. Matthews), against her husband, William Allan Heenan (Mr. Osburne Lilly), came before Mr. J. W. Poynton, STMT., yesterday, at the Magistrate's Court. . •-•• • -••' . • Evidence was given by the complainant that since her marriage defendant .had not adequately maintained her. There were two children, one ofvwhom was now cared for by complainant's mother, and the other by defendant's mother. Complainant had received practically nothing from her husband for the last five months. Defendant stated that he had been as-, sisted by the Repatriation Department to start fishing at Thames with a launch, but owing to misfortune he had been compelled to give up the venture, and had returned the launch and gear to the Department. His gratuity money, amounting 'to about £41, had been chiefly used in paying debts. He could not procure a house in .Auckland, but was prepared to tike furnished rooms for, his wife.. His earnings at wharf work now, averaged from £3 16s to £4 a week. - / A? .;• -,' The | magistrate said he would not make any order for separation, but he considered ' the defendant had been * unduly neglectful. Defendant was ordered to pay 30s a week for the maintenance of his children, the amount of £15 for past maintenance to.be liquidated at the rate of 10s a week.
