SOLDIER'S LEGACY.
INVALID CANCELLATION.
BEQUEST TO LONDON" GIRL.
An originating summons by the executors of Richard Mapp, deceased, namely, Miss Ellen Mapp and W. P. Hopkins, solicitor, Pukekohe (Mr. Thome), for directions as to whether they should prove a codicil to the will of deceased, was heard by Mr. Justice Sim in the Supreme Court yesterday. The deceased made his will before going to the front, and among other things left a legacy of £250 to his brother, Frank Mapp. Frank Mapp, however, died before Richard, who then made the codicil in qnestkwi, bequeathing the legacy to Miss Elsie Hyde, of London. Id. consequence of orders given to the men at the front to cancel their existing wills and make fresh wills, Richard Mapp wrote the word " cancelled " across tie codicil. The question for the Court was whether the cancellation was proper. His Honor held that the codicil had not been cancelled.
Dr. Fitchett, representing the Public Trustee, appeared for Miss Hvde, and Mr. A. H. Johnstone represented the Auckland Wounded Soldiers' Fund, who would have received the £250 had the decision of the Court been to uphold the cancellation.
