DISPUTE OVER COMMISSION.
LAND AGENT NONSUITED.
A claim for £23 2s 6d by F. Ball (Mr. Scott), land agent, against A. J. Tobin (Mr. Hosting), was brought before Mr. J. W. Poynton, S.M., in the Magistrate's Court yesterday. The amount claimed was alleged to be commission due on the sale of the defendant's property in Charles Street.
The defendant denied that he had given his wife authority to sign the document authorising the plaintiff to sell the premises in question, upon which the action was based, and that therefore no commission was due to the plaintiff on the sale, which was effected by the defendant himself.
The magistrate ruled that the owner's signature affixed to a document by an agent, his wife in the present case, was not sufficient to bring the matter within the scope of section 13 of the Land Agents' Act. Mr. Scott accordingly agreed to accept a non-suit.
