(in liquidation), versus David Joseph Nathan, merchant, Wellington, was heard in the Supreme Court in banco to-day before tie Chief Justice, Sir Robert Stout. The defendant was called upon to answer why an order should not be made in terms of a summons issued on November 1, 1917; or, in the alternative, why he should not be ordered to account to the liquidator of the United Farmers' Cooperative Association for the sum of £850, being the balance of a sum of £2000 agreed to be paid by him to th said liquidator by an agreement dated December 5, 1917. It was alleged that while a director and agent of the United Farmers' Association, D. J. Nathan made a provisional sale of assets of the United Farmers' Association to the Wairarapa Farmers' Association at an undervalue, and procured shareholders of the United Farmers' Association to accept the same withont disclosing to them that he had secured for himself certain benefits.
