MAGISTRATE'S COURT.

SHARE TRANSACTION

The majority of cases which came before the Magistrat-o's Court yesterday were undefended. Mr. C. C. Kettle, S.M., presided.

S. A. Harrison and Co., sharebrokers (Mr. A. L. Denniston), sued Thomas W. Rhodes, farmer, of Thames, for £10 8s 4d, representing calls alleged to have been paid by plaintiff on behalf of the defendant. The latter conducted his own case.

In the court* of his evidence S. H. Harrison said that prior to 1911 the defendant had placed in his, the plaintiff's, name over 4000 shares in the Pride of Tokatea Gold Mining Company. In respect to these shares be had paid a call for £8 6s 8d for the defendant, and a call for £2 Is Sd in respect to shares in the Mountain King Gold Mining Company. Ho admitted that the defendant had told him later that it was not necessary to pay the call in respect to the Pride of losatea shares, as there was money due to him from the company. Prior to the payment of the calls mentioned, the witness continued, he had paid calls for the defendant, who had always refunded the money so paid out. Lengthy cross-examination tock place j in regard to the buying and selling of ; the Pride of Tokatea shares, the defendant I endeavouring to show that at specified i dates the plaintiff had less than the 4000 ! odd shares claimed to be. held for the I defendant.

The case was adojurned until Friday, the magistrate remarking that in the meantime the parties could go thoroughly into thv position.
