TROTTING ON THE WHARF.
AN UNINTENTIONAL BREACH.
Bui-oni: Air. E. C. Cutten, S.M., at tho Police Court yesterday, Major Braithwaite, general staff-officer in connection with tho Auckland district, was charged with a breach of the Harbour Board's bylaws by driving a horse on to Queenstreet Wharf at more than a walking pace; also with failing to lead his horse on the wharf, as enjoined by tho bylaws.
It was stated that Major Braithwaite was driving his pony-trap off the wharf at a trot, when ho was warned by a constablo regarding tho by-law, and told to lead his horse. This he did.
Major Braithwaite made an explanation to the magistrate, regarding the incident. Ho hacl no knowledge of the bylaw ill question, and did not know that ho had contravened it in any way until informed by tho constable. Ho' was sorry if ho had broken the by-laws, but. it was quits unintentional on his part. Ho had obeyed the constable's directions as soon as he received them.
The magistrate stated that lio was sure there had been no intentional breach of the. by-laws. Ho had been asked when this ease had been brought before him the first time, to allow tho charge to bo withdrawn, in view- of Major Braithwaito's explanation' to tho secretary of tho Harbour Board. This ho had been unable to do, since tho information had disclosed an offence. In view of the special circumstances of tho offence, however, the defendant would bo merely formally convicted and discharged.
