ALLEGED ILLEGAL SEIZURE.

CLAIM FOR £2500 DAMAGES.

Hamilton, Monday. The Supreme Court wa» occupied all day in hearing the evidence for tho plaintiff in the case of William James Fargher v. William John Holt, in a claim for damages for alleged illegal seizure and sale of stock and furniture valued at £300. Evidence was given at length by the plaintiff, who asked the Court to rule that verbal agreements should over-ride documents.

At the close of the plaintiff's case, His Honor said it was impossible to believe that the defendant had ever put himself in the position of having to finance the plaintiff, and help to " carry him on" to an unlimited extent, even to the extent of purchasing mX) cows for him, as suggested by the plaintiff's counsel. Mr. Cotter, on behalf of the defendant, moved for a nonsuit, contending that tho defendant had no case to answer.'

His Honor said there was a reasonable ground for the application, but he preferred to hear tho whole of the evidence.

At this stage the Court adjourned till to-morrow, to allow of a conference between counsel, with a view to shortening the proceedings.

Mr. H. Gillies appeared for the plaintiff, and Mr. T. Cotter, instructed by Mr. McVeagh, for the defence.
