At the Police Court .yesterday, before Messrs. R. Hobbs and H. Schofield, J.P.'s, Nicholas Saunders was charged with travelling on a tramcar belonging to the Auckland Electric Tramways Company, Limited, and avoiding. to pay his fare, and, further, with refusing to leave the platform when requested to do so by the conductor. He was convicted and ordered to pay the costs; of the prosecution. / James McCullough was charged with wilfully travelling beyond the section while on an Onehunga car. Defendant stated that he.-Was so engrossed in certain literature that he was unconsciously carried beyond his destination. The information was dismissed.

Charles Andreae was charged with avoiding to pay his fare whUe travelling in a car. The defendant boarded an Onehunga car at Shortland-street as it was on its way to the terminus, in order that he might retain a seat to Onehunga. He was . ask<d for a )penny fare for ; his ride to the* }terminus from Shortland-street; but he refused to pay it, stating that he had a return ticket. He then gave his name ./and address, in order that there might be no misinterpretation placed upon/ his action. Defendant's counsel, Mr. McVeagh, argued, that his client had not;" avoided" payment of his fare, had not ; endeavoured to cheat tor defraud' th<s company in any way of Id; but had opfenly refused to pay something- which hf contended the company had no right t& ask him for. Mr. McVeagh urged that jhe company's proper remedy was a civil one. The Bench took this view of'the matter, and dismissed. the information. ;
