APPEAL COURT JUDGMENT.

Wellington, Friday. The Appeal Court to-day gave judgment in Rex v. McCann and Brown. The point was whether a judge could comment on the refusal of a prisoner to give evidence in his own defence. Separate judgments were delivered by each of the five judges who heard the case, Judges William'', Denniston, and Cooper holding that a judge could not comment, and Judges Edwards and Chapman dissenting. The conviction, therefore, was quashed by a majority of the Court.
The Appeal Court was expected to give judgment to-day in the case of Campbell v. the District Land Registrar of Auckland, but judgment was deferred until February.
