AN APPEAL CASE.
[BY TELEGRAPH.—OWN CORRESPONDENT.] Thames, Tuesday. In the Wardens Court to-day, Messrs. Tunks and Burton, solicitors, of Auckland, appeared to argue certain questions with reference to an appeal in the* case of James Adams v the Waihi Gold Mining Company, which was a claim for £1500 for alleged injuria sustained by the plaintiff in the.defendant company's mine, as far back as August 21, 1900. The action was heard at a sitting oi the Wardens Court, held at Paeroa in December last, when Mr. Burton appeared for the Plaintiff, and Mr. Junks for the defendant" company, and judgment was then Sen by Mr. Warden Bush for the defendant. Against this judgment the plaintiff has -riven notice to appeal, and as counsel on both sides had failed to agree upon a case f«r anoea! it became the duty of the Warden, under sec ion 231 of the Mining Act, 1898, to submit a case, and counsel therefore appeared before him to-day for the purpose of arguing certain questions pertaining to the appeal.. A case will be stated by the Warden and forwarded to the Supreme Court,
