DEPENDENCE OF DISTRICT COURT JUDGES.
[BV TELEORAPH. —PRESS ASSOCIATION.] Wellington', Wednesday. The Carterton libel cases of FTornsby v. Moriarty and Moriarty v. llornsby were mentioned in the District Court at Masterton this morning. Counsel for Hornsby applied for an adjournment on the ground of Parliamentary privilege. This was objected to. District .Judge Kettle said that as District Court judges were not independent he would decline to hear a case in which a member of Parliament: was concerned, he being dependent for his salary upon the Legislature. Ho advised that a writ of certiorari be obtained to remove, the cases into the Supreme Court. Counsel for Moriarty said he would apply for a mandamus to compel Judge Kettle to adjudicate.
