Botoiti, A statement comes from the West Coast to the effect that Whitney met with a bad accident recently while being schooled over hurdles. Whitney is engaged in the A.R.O. Grand National Hurdle Race.

London, May 8. The Prince of Wales' colt Diamond Jubilee is favourite for the Derby at 7 to 4; Mr. B. A. Bnco's colt Forfarshire holds second placo in tlio quotations, at 100 to 30; and Lord William Beresford's American-bred gelding Democrat follows at 100 to 12.

A DISQUALIFICATION CASE. [BY telegraph:.—press ASSOCIATION.] Wellington, Wednesday. The disqualification of W. Smart, owner of the maro Lady Agnes, and tho- jockey Williams, in connection with the mare's running on the second day of the Wairarapa Racing Club's meeting in January, has caused a considerable amount of comment here. The stewards, on their own action, inquired into the mare's running on the first day as compared with her second essay, with the result that all partios concerned were disqualified for a certain period. Against this decision Smart appealed to the metropolitan club, who upheld the decision of the country club, so far as it affected the jockey, but declined to endorso the disqualification of the owner or mare. On the latter decision the owner applied for the stakes won, but the country club refused the request, appealing to the New Zealand Conference against the decision of the metropolitan body. The matter is one of somo importance to all racing bodies in New Zealand, and Sir George Clifford, as president of the New Zealand Conference, nominated Mr. G. G. Stead, Mr. J. G. Wilson, and himself as an appeal court to hear the appeal of tho Wairarapa Club, the grounds for which were: (1) That no appeal was made to the Wellington Racing Club (metropolitan) within the time mentioned in rule 117 of the rules of racing; (2) in the event of there being an appeal the Wellington Racing Club had no jurisdiction, as the finding of the Wairarapa Racing Club was based on facts; (3) under rule 140 no decision of the stewards of a country club can be reversed, so far as regards disqualification " on its own" course, whether that disqualification bo on fact or law. After a long discussion tho Appeal Board found: (1) Appeal duly lodged; (2) that the Wellington Racing Club had jurisdiction under the decision of the Appeal Board in Lobo ease; (3) that the interpretation of tho words " except, its own," in rule 140, by the Wairarapa Club, was untenable, the object of suoh words being to allow tho club to operate during its current meeting; (4) although the Wairarapa Racing Club was justified in holding a searching inquiry into the running of Lady Agnes, there was nothing in the evidence before the Appeal Board to warrant the disqualification of W. Smart, tho owner, or the marc, but tho decision of the stewards on the question of fact that the mare was pulled the first day must be accepted, and therefore the disqualification of the jockoy, Williams, upheld. Thoy say that Smart i 6 entitled to tho stakes. The Board further say, when notice of appeal is given tho metropolitan bodies and all parties concerned must bo at once notified.
