AN ARCHITECTS ACTION.

Argument in Banoo Court was taken today on the law points raised in an action brought by Mr. Charles Worth, architect, against the Government Insurance Commissioner. Mr. Charles. Worth seeks to recover £435. He and the late Mr. F. Toxward had been appointed architects by the old Board of the Government Insurance Department to design and superintend the erection of the building on the present site, The department decided in 1886 nob to proceed with the erection of the building, and arrangements wore come to under which it was agreed that the Colonial Treasurer should pay the architects 2J per cent, on the total coat of construction of the building as a recompense for their preparation of the plans and detailed drawings, and that should the Government decide to proceed with the erection of the building according to the design prepared by the architects the balance of the commission, 2£ > per cent, should be paid to them in return for their services in the supervision of the erection of the building. After Mr. Tox ward's death the Government decided to abandon the plans prepared by Messrs. Charles Worth and Toxward, and had , new designs prepared for the present building. Mr. Charles Worth then brought an action to recover his share of the 2& per cent, commission, and the argument to-day was on the law points raised before the trial. Justice Richmond roserved judgment.
