[1 At the Police Court Mr. Uarew gave judgv meut in the test cases brought by the Dune edin Jockey Club against the disqualified bookmakers, charging them with trespass. Mr. Carew found both guilty, and inflicted a r fine of 50s each, with costs, making a total in 0 Brown's case of £4, and in Jones' case £5165. ' He declined an application not to record >f judgment in order to permit of an appeal to s the Supreme Court. i. In giving judgment Mr. Uarew said it was [. contended that the defendant was on the racecourse by license of the Jockey Club, and i, that whether that license was properly issued released a question of title that ousted the '" jurisdiction ot the Court. In the first place 3 there was a doubt in his mind whether the 6 defendant did not procure a ticket. Itseemed '» strange that he should have bought one hav--1 ing no intention of using it for its proper r purpose to get admission at a gate; that v when ordered to leave the course he made no claim that he had a ticket; and that he produced no ticket in Court to verify his statement. He (Mr. Carew) felt a strong doubt '■• on the question, but would not go so Far as to >1 say that the defendant and his witnesses had I sworn falsely. Assuming that defendant v had a ticket, did the evidence show that he went on the land and refused to leave ' it in the bona fide exercise of a claim of right to be there. He knew that he was disqualified, and had been turned off the f . course before, and that a ticket would not • procure him admission. A license meant a permission, and if obtained by misrepreseni tation and deceit, or by mistake without t fraud, it was a nullity. In this case the dei feudaut's evidence showed that he knew he had not the club's permission to go on the 1 course, and that he went there and remained there against their will- In the face of this he, ' Mr. Carew, could not see any bona fide question of title.
