James Raev. Thomas Craig.—This was an action brought to recover a sum of £12 due on a promissory note. Mr. Hudson Williamson appeared for the plaintiff, and Mr. Devore for the defendant. The plaintiff produced the bill made by a man named Coyle, and endorsed by the defendant. The defendant had admitted his liability on the bill, and paid £2 interest to have it renewed for three months. The bill was now twelve months overdue, in cross-examination the plaintiff said he had given a notice of dishonour when the bill became due, but he had not a copy of it. He had made a claim of £37 against, Craig, there being another bill of £25. A meeting of Craig's creditors was held in Devore and Cooper's office, and he received a dividend of 8s in the pound, which he in his own book paid to the credit of the £25 bill. He could not positively say whether the dividend was paid on the full amount. Mr. Devore said he had no witnesses to call. The defendant unfortunately was ill, and unable to leave his house, but he addressed the Court contending that credit should be given tor the 8s dividend on the £12 bill, and that Mr. Kae was wrong in crediting it to the £25 bill alone. His Worship said, in his opinion, the dividend should extend over the whole claim of £37. Mr. Williamson said Mr. Rue was quite willing that it should be so. Judgment was given for plaintiff for £7 4s and costs £2 Is. Elizabeth Griffin v. T. H. Brister.— This was an action to recover £9 5s fid, due for wages. Mr. Devore appeared for the plaintiff, and defendant appeared in person. The plaintiff deposed to the wages being due. Tito total amount of the claim was £11, bub she gave credit for £1 14s Gd, which she received on account. The defendant, in his cross-examination, attempted to show that he had paid plaintiff various sums besides those for which she gave credit, but she positively denied ever having received more than £2 10s, and she had to pay 15s Gd of that for withdrawing a summons which she had taken out against the defendant, the withdrawal being at his request. The defendant denied that he had arranged to pay the plaintiff 10s a week, or any specific sum. lie had taken her and her child in on the understanding that she was to do some light work. He swore he had paid her various sums at various times, bub could not state what these amounts were. Judgment was given for £S 10s and costs, £1 lis.

POLICE COURT.— [Before Mr. K. S. Bush, It.M.

DRt'NKKNNEss.—II y. Robertson, charged with being drunk in Queen-street, was lined 10s and costs, or 4S hours' imprisonment. Norah Williams, for a similar offence, was lined a like amount.

Au.kued Assault and Robbkry. —Tames Glover and Henry Smith, on remand, were charged with having, on tho '24th July, unlawfully and violently assaulted one Arthur Cottle, also stealing from him five £1 notes and Gs. Mr. Cooper appeared for the accused, Glover, ami Mr. Buddie for Smith. Counsel for the defence notified the Bench that after considering tho matter they had decided not to call evidence. Accused were duly committed for trial, bail being allowed, each of the accused in his own recognisances £100, and two sureties of £50 each.
