Tub cases in connection with the Picturesque Atlas Company which were adjourned to permit of getting a deed of assignment from Sydney, were resumed to-day, when judgment was given in favour of Bowerman. Leave. to appeal was given. The point raised , t by Air. Jowet was that the deed of assignment .was August 13th, 1886, and there was no evidence of any contract till August, 1887, consequently the contract could not be assigned by the deed. The power of attorney only referred to what was assigned, and the plaintiff, thereore, had shown no authority, to sue.
