EXPENSES OF WITNESSES.

The often debated question as to tendering travelling expenses to defendants in a judgment summons cp.se was argued in the Resident Magistrate's Court, to-day. The defendant, who has been for some years a rabbit inspector, and has just finished the property tax valuation of a district, did not appear, and counsel assigned as the reason, that he had not been tendered expenses. Counsel for the plaintiff urged that he could prove that the defendant was in a position to pay, and also to pay the expenses of appearing, and that the provision as to the tendering of expenses was not intended to shield those who had means to pay. The Residonc Magistrate referred to the decision of Justice Williams, which was in favour of the defendant, but evidently thought there was something in the counsel's contention, and he reserved his decision until to-day,
