Mr. Harper, for the defendant, contended '.hat the stewards were not liable for stakes, as under the rules of racing now in force. the treasurer or secretary ot tho club was the stakeholder. Mr. Nolle, for the plaintiff, contended that the defendant, by accepting office as steward, had rendered himself liable for the safe keeping and proper allocation of stakes, Mr. Bell, the real proprietor but nominal secretary, having filed the day after the meeting. Judgment was reserved.
