CITY EAST LICENSING COMMITTEE. THE WAVERLEY LICENSE.

.An adjourned meeting of the City East! licensing Committee was held yesterday fop the purpose of hearing an application for the transfer of the license »i the Waveriey Hotel from G. I. Panter to Daniel ArkelL Present': Mr. J. Newman ' (Chairman), Messrs. T. B. Hill, J. Edson, J. Buchanan, and T. Fry. ' ' ■ >. Mr.- Cotter appeared to support the application. The application had been'adjourned pending the judgment of the Kesidenft Magistrate on the validity of the license. Mr. Cotter said sinoe the last meeting of the committee the Resident Magistrate ruled that the license was a valid one. ; There yna an intention on the part of the informant to appeal, but he had subsequently decided notto go on with it, and the judgment of the lower Court therefore remained, and he now" renewed the application for the transfer. There was no valid objeotion to the transfer. The police approved of the transferee. He was aware that the committee had'power to object on their own motion, and quoted the section. He quoted the section of the Act which gave this power, pointing out that it was implied that the only objection oonld be to the person of the transferee, and if it-was refused the license reverted to the transferer. Mr. Arkell having purchased Mr. Panter's interest, would, he asked, the Bench insist on a re-sale of the property to reinstate Mr. Panter. Although the Benoh was elected, yet when elected they were bound to admister the Act as it was, and not to prejudge the case, or come here to carry out thoseobj«cts which, while they were private individuals, they were perfectly justified in doing—that was, tooppo3e the transfer of the license to the present premises. A duty was cast on them not oily to protect the publics, bat the publican as well,. and not to punish him for the supposed mistake of the previous committee in granting the transfer to the present premises,. The Bench retired to. consider their decision. On their return to Court, the Chairman, before giving their decision, complimented Mr. Cotter on the able manner in which the application had been put befoie them. They had come to the conolosioa that previous transactions in regard to tilts license were errors, and the Bench oonld not see its way to perpetuate those errors, and deolined to deal with the license in any way.
