SUPREME COURT.—IN Banco.
Wednesday, Junk 19. [Before Mr. Justice Gillies.] TIERCE AND ANOTHER V. CIIISHOLU AND OTHERS.—This was a suit by the trustees under the will of the late li. Chisholcn, to have certain trusts under the will declared. Mr. Whitaker appeared on behalf of the trustees, and Mr. Hesketh and Mr. J. E. Mncdonald for the sereral parties interested under the will. Mr. Whitaker pointed out that the trust for the longer period waa bad ut law, and he thought the trust for the shorter term of rive years was also bad. The trustees wore not prepared to administer the trusts, except under the direction of the Court. He went fully into tlio matter, and quoted numerous authorities bearing upon both sides of the e:\se. -Mr. Macdenald And Mr. Hesketh contended that the trusts could not be patched up so as to make them legal. The argument was not concluded when the Court rose.
