Ik Chambkes. pairchilt) v. bbookfield. This waa an application by Mr. Lusk on behalf of plaintiff for a commission to examine witnesses out of the colony. Mr. Whitakcr appeared for the defendant. Application grunted as of course, with leave for defendant to move for another commission. T. 8. WEBTOS V. A. EAST. This was an application to set aside writ and proceedings for irregularity. By the affidavit of defendant it appeared that the plaintiff had issued a writ under the Summary Procedure on Bills Act against the defendant, who reeides at Hamilton, ninety-two miles from Auckland—allowing only twelve instead of eighteen days to appear, causing an excessive amount for interest and coats ; and before the expiration of eighteen days causing judgment to be entered up and a writ of urrest to issue for tho defendant £16 and costs, amounting to about £10. Mr. MacC'ormick appeared on behalf of Mr. Weston to shew cause, and Mr. J. B. Russell for defendant in support of the application to set the proceedings aside. An order was made setting all proceedings aeide, and directing the plaintiff to pay to defendant the sum of £3 3s for costs.
