It appeared that tho books wore loft in tho entrance to Strata's office by Bowerm.n, and disappeared. 1 o-day the Him sued John Scott. Ho declared that he never signed any order for a book ; that the canvaser (Metcalfe, ho believed) showed him tho pictures of Australia ; that ho said ho had no inlorest in tho othor colonies ; that ho might take a similar work on New Zenland if published ; that Metcalfo staled tint was his own fooling, and that ho was ttym« to get support for such a work. i Ho asked Scott to sign the list of patrons, winch ho did. Scott declared that tho list produced was not tho same, and dobcribcd tho differences. He also affirmed that ho never signed any order. A bank oHicihI doposod that to tho best of his bo hof the sigtmture's were all Scott's. Mr Raws™, RM., gave judgment for defendent on tho ground that ho had boon fraudulently induced to sign tho order for the Picturesque Atlas of Australasia, at tho timo believing ho was signing tho patrons' list for a similar work referring to New Zerlatid ; that the canvasser represented that Scott should have tho opportunity of inspecting tho work before subscribing for it. Luavo to appeal was refuse on tho ground that tho decision \v,\h on a matter of fact, Motcalfo was not produced.
