TEACHER AWARDED £283

; SEQUEL TO MOTOR ACCIDENT (United Press Association) DUNEDIN, 15th December. Judgment for the plaintiff in the total sum of £283 6s lOd was given byMr J. R. Bartholomew, S.M., in the Magistrate’s Court to-day, when giving his reserved decision in a case in which Catherine McGregor, a school teacher of Dunedin, proceeded against South Road Services, Balclutha, claiming damages for injuries to herself and damages to her car arising from an accident at North Taieri on 20th July, 1934. The hearing took place on 30th November. The accident occurred when the plaintiff’s car, which had just come to a standstill, was struck in the rear by the defendant’s bus, which was driven by William Robert O’Fee. In her claim, the plaintiff stated that the accident was due to the negligence of O’Fee. Her car was damaged, and she suffered concussion, head injuries, bruising of the left arm, back, both legs, and abdomen. Her whole nervous system suffered severe shock. She claimed general damages amounting to £145 and special damages £l5O 19s 4d. After reviewing the evidence, the Magistrate said he was satisfied that the evidence for the plaintiff accurately set out the position. Although the plaintiff gave no signal before pulling up, her stop was a gradual slowing down, and there was ample road room for the bus to have passed. The effective cause of the collision was the negligence of O’Fee, the driver of the bus.
