OWNER'S APPEAL UPHELD

CASE OF STIRLING LADY (United Press Association) DUNEDIN, 13th June. The decision of the appeal judges appointed by the New Zealand Trotting Conference to hear the appeal of Mrs M. Clark, of Winton, owner of the trotter Stirling Lady, against a decision of the New Zealand Trotting Association dismissing her appeal from a decision of the Wyndham Trotting Club, is now announced. The judges, Messrs B. S. Irwin, A. C. Hanlon, and J. S. Sinclair, upheld the appeal, ordered a return of the deposits made by the appellant for the appeal, and referred the question of costs to the Trotting Conference. Their conclusion was that proceedings which purported to be an inquiry by the stewards of the club conse-' quent upon an objection made by a stipendiary steward were irregular; and ultra vires. Quite apart from this conclusion, the judges state that the appellant could succeed on other j grounds. The facts are that in the concluding race at the Wyndham meeting Stirling Lady beat Pot Luck but the judges j placings were reversed by the judicial committee on the ground that Stirling Lady bored in the final stages. The club’s decision was upheld by the Trotting Association, whereupon the present proceedings were taken.
