OWNERSHIP OF LAKE BED

CLAIMED BY THE CROWN (United Press Association) AUCKLAND, 22nd May. A case of considerable interest concerning the ownership of the bed of Lake Omapere, between Ohaeawai and Okaihau, North Auckland, will be called at a special sitting of the Native Appellate Court of Auckland on Tuesday. This is an appeal by the Crown against a judgment of Mr F. 0. \. Acheson in the Native Land Court in favour of Maoris. The Maoris claimed that the area now covered by the lake, which is a very shallow body of water, was originally dry land but as the res lilt of extensive fires the surface was lowered and became covered with water. The area has been claimed as Crown land but the Maoris hold that it was never sold to the Crown. The Crown contends that the area iiad never been Native land but that it was alwavs under water.

It is stated that this is the first occasion on which claims of this nature have been fought in the Appellate Court.
