HUSBAND’S PETITION DISMISSED, WIFE’S COUNTER ACTION ..■ (By Telegraph—Press Association), AUCKLAND, 18th August. The hearing was concluded in the Supreme Court of the petition for divorce brought by Kenneth Rahiri Richardson against Mona Mary Richardson, the petitioner alleging misconduct. The jury found that no misconduct had occurred, and the petition was dismissed, with costs against the petitioner. /■' J The case, which lasted seven days, was heard before Mr Justice Smith. The petitioner cited as co-respondent Tlaijry Reginald Jenkins, company director, of Auckland, claiming from him £IOOO damages. Did the co-respondent commit misconduct with the respondent? (3) The damages, if any. The jury retired at 4.20 p.m. and returned at 5.50 p.m., when the foreman announced that their answer to questions 1 and 2 was “No.” Mr Singer asked that the petition be dismissed.

His Honour: “Yes, the petition is dismissed.” Mr Singer asked for costs on behalf of the respondent, and Mr Johnstone requested costs on behalf of the corespondent, which were granted in each case.

Mr Singer: “I have, my client’s instructions, sir, to ask if you will be good enough to hear her divorce petition to-morrow. Failure to comply with an order for restitution of 'conjugal rights was the ground of an application for divorce brought by Mona Mary Richardson against Kenneth Rahiri George. Richardson in the Supreme Court. The application was not opposed, and after hearing evidence Mr Justice Smith granted a decree nisi, to be moved absolute after throe months.
