MAGISTRATE'S COURT.

(Before Mr J. S. Evans, §.M.) COL&INGWOOP, A sitting of the Magistrate's Cpurt was held at Collingwgod on Thursday last, ivhon the following oasese were dealt -with:^ A. King (Mr Hayes) v. CqllingwQod County (Mr Maginnity), This was a claim for £121 6s, balance due on a contract foT road formation. Tl»e plaintiff had formerly sued for $Hl 6s, 'but the cage had been referred to arbitration, the disputed part of the work being estimated at £20, The arbitrators ordered tho plaintiff to do cortain work (valued ot aboulf£L2), but he refused to dot it, and so brought a fresh -action for the £121. Mr Evans delivered a reserved judgment, holding that the arbitration agreement had set tho terms of the contract at large, and made the £121 payable immediately. Judgment was given for the plaintiff for tho full amount claimed, with £10 14s 6d costs. J. W. Ferguson (Mr Atkinson) v. Falconer arid Co] (Mr. Hayes), a claim of £7 Is for damages suffered' thpugh the alleged -wrongful seizure 'by' defendants of stock over which they held a bill of sale, and also through the non-payment at due time of moneys agreed to be paid for stock bought iby plaintiff. After a longthy hearing his Worship held that the seizure of tho stook was Hot wrongful, and that the plaintiff had no cause of action in respect of the rest of the claim. Judgment for defendants with costs. ■ -j i i James Hargreaves (Mr Houlker) v. Thoß. Hawthorn (Mr Hayes), a claim for £12 8s 3d admitted to be due by a letter from defendant to plaintiff. Mr Hayes submitted that the letter could not be sued on. After argument Mr Houlker elected to take a nonsui, and the plaintiff was nonsuited, with costs £1 11s 6d. Stephen Harvey (represented by Mr Hayes) pleaded guilty to a charge of permitting cattle to wander at large, and wag frned 5s and eqsts.
