Green, of Blenheim, auctioneer. Plaintiff sued for £90, six months rent due for rent of sections in the Opawa district, for which a promissory note had been tendered, but was dishonoured. Defendants evidence was that in 1891 an agent of the Company called on him and Tiired a sulky for which ho was charged 15*. Defendant signed a paper contracting to take the Trades Auxiliary Company's paper (the Mercantile and Bankruptcy Gazette) for a year at 30. He paid the agent los cash and the temaining half was settled by the contra account for the hire of the sulky. Subsequently defendant gave notico that he desired to discontinue taking thepaper, and now denied any indebtedness to the plaintiff.
