Woman's Claim Against Farmer
DARGAVILLE, Sat. (Sp.)—An interesting feature of a damages claim resumed in the Dargaville Court yesterday was the quotation of English Court of Appeal decisions to the effect that there was no common law liability on a landowner to fence his land to prevent his stfel; from straying cfn to a highway. The case was one in which Mrs Iris Elsie Neeley claimed £3OO damages for injuries, medical treatment and damage to clothing, from James Middleton, farmer.
Mrs Neeley in August. 1946. when walking to a neighbour’s homo on Kairara Road, was charged by a steer alleged to be owned by defendant and to have been turned on to the road by him.
After six witnesses had been called !or the defendant, decision was reserved by Mr W. Carrol Harley % S.M.
