Important Judgment
The position of the executor of a will in the event of a successful attack on the will after a distribution has been made in good faith to legatees is defined by Mr Justice Northcroft in his judgment in the action recently taken by the Public Trustee against the Guardian Trust and Executors Company of New Zealand, Limited. Judgment is given for the defendant, with costs, so that the Public Trustee has failed in his claim to recover £8450 paid out by the defendant as executor under the will—subsequently upset by the Court after probate had been granted—of Miss Elizabeth Smith, who died in Christchurch on July 9. 1935. leaving an estate of £60,000.
