ADMITTED TO PROBATION

ELDERLY MAN’S LAPSE * At a sitting of the Magistrate’s Court in Maungaturoto on Tuesday afternoon, before Messrs W. Dell and W. Collins J.P’s., John Marval Payne Tapp, of Maungaturoto railway station, was charged with an attempted indecent act at Maungaturoto on November 6. Accused, who pleaded not guilty, was represented by Mr K. C. Aekins, of Auckland. Constable Cannon prosecuted. Evidence relating to the charge was given by a little girl and her parents. In making a strong plea for leniency for the accused, Mr Aekins stressed the fact that accused was an elderly man and had been drinking at the time the offence was committed. Counsel submitted testimonials from former employers stressing Tapp’s previous good record. The child concerned had not been injured, and it was a mild form of this particular offence.

Tapp was sentenced to 12 months’ probation.
