The sequel to the shooting of a racehorse named Loving Cup after it had run second in a hurdle race at Ellerslie in June* 1933, was hoard at the Siqiremp Court this afternoon, ALoviug Gup, which was the property of Messrs Mervyn Wells and Janies Taylor, farmers, of Cambridge, was accompanied to the meeting by his stable companion, a horse named Glen Maree. After running fourth in the Hunt Steeplechase, Glen Maree ■ broke down, and it was decided to destroy him. Along with Loving Cup, he was sent to To Papapa boiling down works. There the wrong horse was shot. Plaintiff's in today's action were . Messrs Wells and Taylor, and defendant N. Austin, proprietor of the boiling down works. Plaintiffs claimed £7OO for the loss of the horse, on the ground that he was negligently shot. The claim was .defended, two counsel appearing for both sides. The defence was a denial of negiigenee. It was alleged on behalf of the defence that Loving Cup was- destroyed owing to the negligence of Wells in leaving the horse in . the same paddock as Glen Maree. Counsel for plaintiffs said Austin was the proprietor of a boiling-down works. I It was alleged that, owing to gross negligence on the part of his son, the : wrong horse was destroyed. In a pad- ; dock adjoining the stable were a thoroughbred filly, the horse Loving Cup, ; Glen Maree and another cross-country | horse named Nukatere. "The amazing 'Xeature of this case," said counsel, "is -jthat the son of defendant, instead of j making the fullest inquiry, shot Lov- ; ing Cup. Surely he might have made : inquiries as to which was the horse." Earlier in the year, continued counsel, Glen Maree broke down, and had been turned into a paddock owned by Mr Hannon. It was hobbling about with great difficulty, hardly able to : get about at all. Mr Wells also owned a beautifully-bred gelding, Loving Cup, by Quin Abbey out of Shell Shock. Loving Cup Jiad shown great promise in his earlier career and was expected to do well in the future.
